CONTROLLED DRUGS AND CANNABIS
Alan D. Gold, B.Sc., LL.B.
Canada's federal drug control statute sets out a detailed listing of controlled drugs and substances, providing authorities with a broad set of powers regarding search and seizure and other measures that may limit personal liberty, with implications for criminal law, health law, constitutional law, consumer safety laws and even real estate law. In October 2018, possession, consumption and other activities in relation to cannabis became legal, and federal, provincial and territorial legislation was enacted to regulate its quantities and requirements.
Halsbury's Laws of Canada – Controlled Drugs and Cannabis (2021 Reissue), written by one of Canada's pre-eminent criminal law practitioners and authors, provides an unparalleled summary of drug control legislation and cannabis legislation. With respect to drug control, the title examines possession, trafficking, importing and exporting, production, making false or deceptive statements, Criminal Code offences, prosecution of offences, sentencing and prescribed enforcement measures. With respect to cannabis, the title examines legalization, production and cultivation, promotion and packaging, distribution, licensing and sale, possession and consumption, importing and exporting, enforcement and offences and penalties.
CROWN
Tom D. McKinlay, B.A. (Hons.), LL.B.
The Crown is involved in all aspects of the administration of justice, through statutes, regulations and policies. At both the federal and provincial levels, the Crown is the most frequent party involved in judicial proceedings in Canada. Legal practitioners in all areas must understand the unique rights and protections enjoyed by the Crown and its pivotal role in the justice system.
Halsbury's Laws of Canada – Crown (2021 Reissue) details the rights and responsibilities of the Crown, including Crown prerogatives and Crown immunity. It examines the Crown's privileges and potential liability in various contexts, such as tort, contract and property law, providing insight into its dual role as advocate and protector of the public interest.
