Product description
This service provides the most comprehensive and up-to-date analysis of workers' compensation law in Ontario. It should be considered a required resource for all legal professionals who practice in this area and who wish to be aware of the current and former legislation that may be applicable to a claim for benefits as well as the policy documents and most important Appeals Tribunal decisions that may affect a claim. Topics covered include those affecting initial entitlement (arising out of and in the course of disablement, occupational diseases, stress claims, etc.); the determination of pre-injury earnings; the payment of benefits (NEL, FEL, LOE, survivors' benefits, and health care); and the appeals process that exists within the WSIB and at the Appeals Tribunal.
Legal professionals, human resources staff and union advisers will benefit from the extensive information in the service regarding re-employment obligations, what constitutes a suitable employment offer by an employer and Labour Market Re-entry (Workforce Re-integration).
A chapter of the service is dedicated to describing the registration and assessment obligations of employers as well as the opportunities that exist for employers to achieve cost transfers from the WSIB.
