Product description
- Les dispositions pertinentes du Code de procédure civile, notamment les articles 571 à 604;
- Les Commentaires de la ministre de la Justice qui s’y rapportent;
- Des notes explicatives de la part des auteurs qui élaborent et mettent en contexte ces dispositions;
- Des lois, règlements et directives connexes, le cas échéant;
The class action is one of the law’s most powerful, flexible, and unique procedural vehicles. Nevertheless, Québec’s doctrinal authority, although instructive and relevant, is less copious than its subject.
Following a qualitative rather than quantitative approach, this bilingual and annotated book includes and renders easily accessible the following content:
- The relevant provisions of the Code of Civil Procedure, notably articles 571 to 604;
- Related comments issued by the Minister of Justice;
- Explanatory notes by the authors that develop and contextualize these provisions;
- Related statutes, regulations, and directives, as the case may be;
- Extracts from the jurisprudence that explain and apply the law; and
- Finally, procedural models included with the specific codal articles that provide for them.
The main purpose of this book dedicated to class actions is to provide the information and tools sought by in-house counsel, practitioners, law students, and even courts, whether they are in Québec or common law jurisdictions.
This work occupies a key place in the class action literature.
Foreword by The Right Honourable Richard Wagner, P.C., Chief Justice of Canada
